TERMS AND CONDITIONS

SELLING TO US :

MEMBERSHIP
1.1 Zetavintage offers both online and in-store memberships. These are not interlinked at present.
1.2 Memberships are not required to buy a Product in-store; however, this may be offered.
1.3 Membership is mandatory to Purchase a Product online.
1.4 Membership is required to sell or Exchange Products in-store or online.
1.5 When selling to Zetavintage, Zetavintage will create an instoremembership alongside the online membership. Customers will need to provide information within the ‘Seller ID’ section on ‘Your Account’ on the ‘zetavintage.com’ website. This is required to process the transaction.
1.6 Photographic ID is required for registration of an in-store membership. This must be an in-date and valid driver’s license or passport.
1.7 All Customers with a membership must be eighteen [18] years of age or older.
1.8 Users seventeen [17] or under may only use the Zetavintage website with the involvement of a parent or guardian.
1.9 The Personal Information which the Customer is required to provide when registering must be true, accurate, current, and complete in all respects.
1.10 The Customer must update their online and in-store account to reflect any changes to personal information.
1.11 The Customer must agree not to impersonate any other person or entity or to use a false name or a name that they are not authorized to use.
1.12 The Customer must only have a maximum of one [1] in-store membership and one [1] online membership.
1.13 When selling to Zetavintage, Zetavintage will create an online membership using in-store details. This will be done when the action is required to process the transaction.

Authentication & Valuation Testing
1.2.1 All Products sent via post to Zetavintage are made pursuant to a shipment contract. Prior to Zetavintage receiving such Products, the risk of loss and title for such Products remains with the Customer.
1.2.2 Customers must ensure that all parts of the order are given to Zetavintage at the same time. Should Zetavintage receive only part of the order, Zetavintage may not be able to complete the transaction or will only process the Products that Zetavintage has received. Zetavintage will not take responsibility for incomplete orders.
1.2.3 While Zetavintage will make every effort to look after Products left by Customers for authentication and valuation testing, they are left at the Customer’s own risk.
1.2.4 Zetavintage reserves the right to send photographs of customer’s Products to a third-party company for a second opinion.
1.2.5 Zetavintage reserves the right to transfer the Customer’s Products internally from one Zetavintage location to another for the purposes of authentication.
1.2.6 Once the Customer accepts the quote, Zetavintage will proceed with steps to process the order without further communication unless, after physical inspection, the Product is given a lower price. If that happens, the Customer will be emailed and given a chance to accept the new price or have the Product sent back to their registered address.

1.3 Purchasing & Processing
1.3.1 By submitting an item for sale at Zetavintage, Customers guarantee that the item is free from finance or theft, and is guaranteed authentic. In case the Product is later found out to be stolen, or encumbered and/or fake, Zetavintage reserves the right to pursue legal remedy (both civil and criminal) against the Customer.
1.3.2 Once an in-store or online final quote has been issued, the Customer must respond within fourteen [14] days or the Products will be treated as Abandoned Products.
1.3.3 Zetavintage issues payment on the basis of details provided by the Customer and shall not be liable for payment made to the wrong account or to a non-existent account due to incorrect details.
1.3.4 Estimated or marketed purchase times such as the payment message timeframe are guidelines only, do not include weekends / bank holidays and subject to change at any time and for any reason.
1.3.5 Estimated or marketed purchase times such as the estimated time of payment message do not include any time waiting on a Customer’s response. Some Products also may take longer to process due to additional authentication processes and orders with over three [3] items will take longer than projected. 1.3.6 Once the final quote has been accepted then the transaction will be processed and this will be final. It cannot be unprocessed at the request of the Customer.
1.3.7 Zetavintage reserves the right to refuse to purchase any Product for any issues relating to stock management, price, authenticity, or the financial situation of the company.
1.3.8 Title of the Products and ownership shall pass to Zetavintage once the purchase has been made and the payment method raised.

1.4 Failed, Rejected & Abandoned Products
1.4.1 Rejected Products are potential purchase orders that have not been completed by either Zetavintage refusing to purchase or the Customer rejecting the final quote.
1.4.2 After the final quotation, Customer’s Products are held for fourteen [14] days. After fourteen [14] days, they are classed as Abandoned Products and Zetavintage will, subject to authenticity, either dispose of them at the Customer’s expense, adjust onto stock for general sale or post back to the Customer.
1.4.3 Zetavintage does not guarantee to ship, post, or deliver abandoned or rejected Products. The Customer may need to collect the items or can arrange for a courier to pick them up at their own expense.
1.4.4 Abandoned or rejected Products can only be given to the original Customer.
1.4.5 Zetavintage reserves the right, in extreme situations, to post rejected or Abandoned items back to the Customer’s registered address on their online or in-store membership. Zetavintage is not liable should the address be incorrect or it is lost in transit.

Zetavintage (“The Company”) offers services (the “Zetavintage Services”) through which you can sell certain vintage items (the “Products”) after receiving an “offer” from Zetavintage by identifying your Product or completing check-out on the Zetavintage Website. You must agree to abide by the following terms in order to use the Zetavintage Services and/or the Zetavintage Websites.
Zetavintage is an independent company not affiliated with any specific vintage brand.

BY SETTING UP AN ACCOUNT, OR BY USING ZETAVINTAGE’S WEBSITE, YOU SIGNIFY THAT YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS, WHICH MAY BE AMENDED AT ANY TIME BY POSTING THE AMENDED TERMS ON THE ZETAVINTAGE WEBSITE. ANY AMENDED TERMS WILL BE AUTOMATICALLY EFFECTIVE IMMEDIATELY AFTER THEY ARE POSTED. Zetavintage reserves the right to terminate or suspend your use of the Zetavintage Website and/or the Zetavintage Services if you do not comply with this Agreement or any other Zetavintage policy or procedure, or for any other reason we determine, in our sole discretion.

About These Terms. These terms govern any offer that you receive to sell your Product to or through Zetavintage. These terms, the terms that govern your use of Zetavintage’s website (“Zetavintage Website”), the Zetavintage Services and any and all applications included therein, the terms of Zetavintage’s privacy disclosures and any supplemental terms or policies that accompany a specific transaction, feature or application collectively make up an agreement between you and Zetavintage (the “Agreement”). You acknowledge that this Agreement is in electronic form and has the same force and effect as an agreement in writing. In this Agreement, the term “you” or “your” means an individual or entity exercising rights under this Agreement, and the term “Zetavintage,” “we” or “us” means Zetavintage and its affiliates and subsidiaries.

Customer Accounts: Zetavintage retains the right at any point to temporarily or permanently suspend accounts. Especially in instances of repeated, excessive returns or cancellations, we reserve the right at our discretion to limit or deny access to the client’s account.

Requirements. In order to complete the sale of your Product to or through Zetavintage or to complete any other transaction with Zetavintage, you must: (i) Place an order for a bag or schedule a pickup; (ii) Provide accurate and up-to-date account information about yourself and any Product you submit to us; (iii) Adhere to all terms and conditions outlined in this Agreement; (iv) Follow all relevant laws and regulations, including those pertaining to import and export; and (v) Have the legal capacity to enter into agreements and to transfer ownership and interest in any Product you submit to us. To receive payments for Products we purchase from you, you must supply us with information including a valid email address capable of receiving email, a valid postal address capable of receiving mail, and your first and last name. Zetavintage bears no responsibility for communication errors resulting from inaccurate or incomplete contact information provided by you.
It is your responsibility to ensure you can receive emails from Zetavintage; Zetavintage is not liable for any emails that are not received due to blocking or filtering as spam. If you fail to provide accurate and up-to-date information about yourself: (a) we will not be liable for any misapplied payments or payments sent to an incorrect address, and (b) any unclaimed funds may be subject to collection by governmental authorities under applicable unclaimed funds and escheat laws. You agree that we have no obligation to you if any of your unclaimed funds are turned over to governmental authorities.

Product Eligibility. Zetavintage reserves the right, at its sole discretion, to determine which Products are eligible for purchase by or through the Zetavintage Services and for which eligible Products Zetavintage will provide an offer. Zetavintage may revoke the eligibility of certain Products at any time and without prior notice, but such revocation will not affect any Products for which you have already accepted an offer. Unless accepted by the customer, all offers made by Zetavintage automatically expire five (5) days after the date they were issued.

Condition Definition. Zetavintage exclusively accepts items in excellent condition, free from noticeable flaws and functional or physical problems. DO NOT SEND ITEMS WITH VISIBLE WEAR AND TEAR OR SIGNS OF USE. Do not send non-operative items or those with physical damage that hinders use. The above definitions serve as general guidelines. More specific condition definitions specific to the category and/or type of Product may be found on the Zetavintage Website offer screen and are considered the effective condition definition for that product. Condition definitions are subject to change at Zetavintage’s discretion. If you are uncertain about your Product’s condition, please contact Zetavintage’s customer care for guidance. Any Product deemed inauthentic by Zetavintage or inaccurately represented in terms of condition will be returned to you for a $10 fee. Failure to pay the $10 return fee results in the Product becoming the property of Zetavintage. This $10 return assurance fee will be deducted from any payment owed by Zetavintage to the seller.

Product Valuation. All offers are based on Zetavintage’s assessment of the Product value, relying on the accuracy of the information provided by you. Zetavintage exercises discretion in determining the Product value, considering factors such as the Product’s model, functionality, and condition, as well as the provision of necessary Product accessories by you. Upon receiving an offer, you may choose to accept or reject it. Acceptance indicates your willingness to provide your Product to Zetavintage at the offered price. Declining the offer results in the specific transaction expiring. If you later reconsider and wish to accept the offer, you must initiate another transaction with us, at which point, provided the Product is still eligible for purchase, the new offer may differ, as Product prices are subject to change.

Sellers: You remain responsible for the risk-of-loss for the Products until delivery of the same to Zetavintage. You are responsible for any damage that may occur to your Product while in transit.
Zetavintage is responsible for the risk-of-loss when it opens the packaging containing your Product and ceases in the event Zetavintage returns your product to you for any reason. For the avoidance of doubt, in such an event, the risk of loss will be transferred to you once Zetavintage delivers the package to the carrier for return to you, and you will bear the risk-of-loss while the Product is in transit. From time to time Zetavintage reserves the right to make an exception to this policy and bear the risk-of-loss at its sole discretion. Any and all packaging and/or collateral is not covered by Zetavintage for any risk of loss.

Buyers: Zetavintage is responsible for the risk-of-loss until the Products are delivered by our designated common carrier to the shipping address you selected at checkout. Risk-of-loss is transferred from Zetavintage to you upon proof of delivery. You may not request the carrier to reroute or divert any shipment; all shipments must be delivered to the shipping address you selected at checkout. Any attempt to do so will immediately release Zetavintage of any risk-of-loss and/or other liability in connection with the Products, and you will bear all risk-of-loss for the Products.

Returns: You remain responsible for the risk-of-loss for the Products until delivery of the same to Zetavintage. You are responsible for any damage that may occur to the Products while in transit.
Zetavintage is responsible for the risk-of-loss when it opens the packaging containing your Products and confirms it is the same item and in the same condition that we shipped to you upon fulfillment of your original order. From time to time Zetavintage reserves the right to make an exception to this policy and bear the risk-of-loss at its sole discretion.
Passing of Title. Title to the applicable Product passes to Zetavintage upon Zetavintage’s acceptance of the Product for the original offer or the new offer, as applicable. If there is a Return Circumstance, title shall not pass and shall remain with you.
Non-Transferable. Any offer by Zetavintage for your Product is non-transferable and not redeemable for any other consideration other than what is offered by Zetavintage.

Import and Export Laws. You agree to comply fully with all import and export laws, regulations, rules, and orders of the United States, or any foreign government agency or authority, and that you will not directly or indirectly transfer your Product without proper authorization from the U.S. and/or foreign government. You bear responsibility for and assume all expenses relating to your compliance with the described laws, regulations, rules, and orders, and for obtaining all necessary authorizations and clearances in order to convey your Product to Zetavintage, including without limitation, valuation, classification, and duties applicable with the import of any goods. Please note: U.S. trade sanctions administered by the Office of Foreign Assets Control (OFAC) generally prohibit the importation into the United States and Canada (including U.S. territories), either directly or indirectly, of most goods, technology, or services (except information and informational materials) from, or which originated from Cuba, Iran, Iraq, Libya, North Korea, Serbia, or Sudan; from foreign persons designated by the Secretary of State as having promoted the proliferation of weapons of mass destruction; named Foreign Terrorist Organizations; designated terrorists and narcotics traffickers. You may not offer or provide to Zetavintage for sale, any Products that would violate the provisions of this Section.

Promotions. From time to time, and at Zetavintage’s sole discretion, Zetavintage may offer promotional programs as an incentive to customers. Promotions applicable to payments are applied as an increment to the final value of a customer’s Product, but they are not considered a change in that final value. Promotional programs have explicitly defined terms, including but not limited to, expiration, usage per person and per transaction, and other limitations and restrictions. Unless otherwise stated, promotions must be applied by you before checkout. Once checkout is completed, promotions cannot be applied to the same transaction. Zetavintage reserves the right, in its sole discretion, to cancel or refuse promotions.
Non-Binding Offers. All Offers from Zetavintage to purchase submitted Products are non-binding and indicative only. Zetavintage reserves the right, at its sole discretion and at any point in time, to cancel any Offer. In case of cancellation by Zetavintage, return assurance fees of $50 per Order still apply. In case of multiple items being returned, the return assurance fee will only be charged once ($50). If you do not pay the $50 return fee, the Product will remain the property of Zetavintage. This $50 return assurance fee will be deducted from any payment due by Zetavintage to the seller.

Fitness for Sale. You must have all right, title, and interest in any and all Products you seek to sell to Zetavintage. The Products and the sale and shipment of such items to Zetavintage: (a) must comply with all applicable laws, statutes, ordinances, including without limitation all import and export laws, (b) may not infringe on third party intellectual property rights (including copyrights, trademarks, patents, trade secrets, or other proprietary rights), and (c) shall not be counterfeit, stolen, or fraudulent. You represent and warrant that the Products are free of any liens or encumbrances. By using the Zetavintage Services, you agree to indemnify Zetavintage from all claims or losses sustained by Zetavintage as a result of any breach of these representations and warranties.
Sending Zetavintage Your Product. When packaging your Product, be sure to include all materials
included in your description when we calculated your offer. This may include particular accessories.
Failure to include any items you told us about when the offer was calculated, or sending us a Product that does not match your original description, may impact the final value of your Product and may result in a revised offer.
Product Inspection; Offer Recalculation. Your Product must be received by Zetavintage within fifteen (15) days after you order the prepaid box or a pickup on the Zetavintage Website or drop your product off at one of our office warehouse locations (the “Delivery Period”) or the offer shall automatically expire. Packing and shipping recommendations provided to you by Zetavintage should be followed to avoid possible damage to or loss of the Product in transit. Zetavintage will inspect all Products received. Zetavintage has the option to accept or reject the Product, including, without limitation, to reject any Product not conforming to the description you provided, any Product modified in a way that no longer conforms to the original factory specifications, any Product no longer complying with applicable laws or regulations (e.g., FCC rules, etc.), and/or any Product damaged or lost in transit. If Zetavintage rejects the Product for any of these reasons, the original offer automatically expires and is rescinded. Zetavintage reserves the right to revoke the original offer and provide a revised offer for the Product if: (a) the Product and/or materials are not as described, (b) the Product is received after the Delivery Period, and/or (c) Zetavintage receives Product(s) that are different from those identified when your offer was calculated.

Recalculated Product Offers after Inspection. If Zetavintage recalculates the offer provided for the Product after it has been received and inspected, as described above, you shall have the option of accepting or rejecting the new offer. If you accept the new offer, you will be paid in the normal course and in accordance with these service terms. If you reject the new offer, Zetavintage will return the Product to you, against a $50 fee, at the address from which it was originally sent.
Zetavintage will give you a period of five (5) days after presenting you with the recalculated offer via email to accept or reject the new offer (the “New Offer Period”). Zetavintage will also remind you of the outstanding new offer one or more times during the New Offer Period. However, if the new offer is neither affirmatively accepted nor rejected during the New Offer Period, it will be deemed accepted and you will be paid the new offer price in the normal course and in accordance with these service terms. Your acceptance of the original offer and/or any new offer is final, and you may not change your mind later.
Releasing Rights to Product. Once you send Zetavintage your Product, Zetavintage cannot guarantee that it will be able to honor any request for return of the Product. If Zetavintage rejects the Product or you do not accept any new offer for the Product (the “Return Circumstance”), your Product will be returned to you as set forth in the previous sections, against a $50 fee.

Authentication. Zetavintage only accepts fully authentic Products. DO NOT SEND UNAUTHENTIC PRODUCTS. Once received, our team of experts will undergo a thorough authentication process.
Our experts have years of experience in luxury fashion and in the brands carried by Zetavintage.
They are extremely knowledgeable and will identify counterfeits. IF YOUR PRODUCT IS DEEMED UNAUTHENTIC, AND AS PER THE REQUIREMENTS OF THE LAWS OF THE UNITED STATES, WE CANNOT AND WILL NOT ACCOMMODATE ANY RETURN, EVEN AGAINST A FEE. The Product will be retained by Zetavintage and destroyed within one month.

Entire Agreement/No Waiver: This Agreement constitutes the complete agreement between the parties regarding the subject matter herein. Captions are solely for convenience and do not constitute part of this agreement or influence its interpretation. No waiver by Zetavintage of any breach or default herein shall be deemed a waiver of any prior or subsequent breach or default.

Correction of Errors and Inaccuracies: The Zetavintage Website and transaction-related correspondence may contain typographical or other errors, inaccuracies, or incompleteness.
Zetavintage reserves the right to rectify any such errors, inaccuracies, or omissions and to amend or update the Content without prior notice. However, Zetavintage does not guarantee the correction of all errors, inaccuracies, or omissions.

Modification: Zetavintage retains the right to amend this Agreement at any time. If you disagree with the modifications, you may cease using the Zetavintage Websites and/or Services. Continued use of any Zetavintage Website and/or Service following such modifications constitutes acceptance of the changes. By submitting a Product for sale to Zetavintage, you reaffirm acceptance of this Agreement as applicable at the time of use. It is your responsibility to review this Agreement with each use of the Zetavintage Website. The last revision date of this Agreement is provided below.
Terms and conditions altering the Agreement are effective upon posting.

Applicable Law and Venue: THIS AGREEMENT, INCLUDING THE TERMS OF SALE AND PRODUCT TITLE TRANSFER, IS GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF CANADA AND THE PROVINCE OF ONTARIO, WITHOUT REGARD TO CONFLICT OF LAW PROVISIONS. YOU CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION OF THE COURTS OF ONTARIO, CANADA, FOR ANY LEGAL ACTION ARISING FROM OR RELATING TO THESE TERMS AND CONDITIONS. ALL DISPUTES SHALL BE ADJUDICATED IN ENGLISH.

Zetavintage Privacy Policy

Please read the following to learn more about our privacy policy, the types of personal information we gather and the steps we take to safeguard it when you use the Website, applications and services provided by us (the “Services”). Zetavintage and its affiliates (“Zetavintage”, “we” or “us”) offer the Services. This policy covers how we treat personal information that we collect and use on or through the Services and other related websites where this policy is posted on the footer of the Web page. You agree that this Privacy Policy is part of our Terms of Use and Terms of Sales Agreement. By accessing or using the Services, you agree to be bound by all of our terms and conditions.

Change to our Privacy Policy

From time to time, we may modify this Privacy Policy in our sole discretion. If we make any updates or changes to this Privacy Policy, all modifications will be posted to this Site, and will be effective immediately upon our posting and, where appropriate, notified to you by post or email. By continuing to use the Services, or using the Zetavintage Website, after updates are posted and effective you are confirming that you have read and understood the latest version of the Privacy Policy.

Information Collection and Use

When you use the Services, you provide information to us. Zetavintage collects two types of information: (1) information that you provide to us that lets us know who you are (“Personally Identifiable Information”) and (2) information that does not by itself identify a specific individual (“Nonpersonally Identifiable Information”).

Personally Identifiable Information

You can browse the Services’ Website without telling Zetavintage who you are or revealing any personal information about yourself. However, when you transact with us (e.g., offer to sell a bag) or register to open an account with Zetavintage, we ask for information about yourself, such as your name, email address, and zip code, which we collect and use as disclosed in this Privacy Policy. Once you submit information about yourself to us, you are not anonymous to us. We may also collect additional information about you when you engage in certain activities on the Services, such as: (a) provide transactional information when you sell, ship, or purchase an item ; (b) when you sign up for special offers; (c) when you visit the Services’ Website or the pages of certain Zetavintage partners ; (d) when you interact with offers and advertisements; (e) when you contact us for help or customer support; (f) when you log into the Services with your account; (g) when you complete a survey; (h) when you post content or provide us with feedback; or (i) when you enter promotions or sweepstakes. Zetavintage might also receive information about you from third parties such as social media platforms and public websites and add it to your account information. Providing information is purely optional on your part; however, not all features and services (such as, responding to your inquiries) would be available to you if you elect not to provide information. If you choose to provide us with personal information, you consent to the transfer and storage of that information by us.

Non-Personally Identifiable Information

We automatically receive and collect Non-personally Identifiable Information on our server logs from your browser, including your IP address, the Uniform Resource Locator (“URL”) that you just came from, which URL you next go to, browser type, browser language, date and time of your query, Zetavintage cookie information, and the pages you request. This information is compiled and analyzed on both a personal and an aggregated basis. We may use third-party analytics services to collect, monitor and analyze the information collected as described above. Use of Information We primarily will use Personally Identifiable Information for the following purposes: (a) to provide the Services to you; (b) to customize the advertising and content you see; (c) fulfill any transactions, including, your requests for products and services ; (d) improve our services and offerings to you; (e) conduct research ; (f) provide you with support; (g) provide you with updates and notices about the Services, our Privacy Policy and terms and conditions; (h) contact you under certain circumstances; (i) provide you with offers from us, our affiliates and from third parties that may be of interest to you, (j) provide anonymous reporting for internal and external clients, and (k) to customize the audience targeting of our advertising. In addition, Zetavintage will use your email address to contact you under the following circumstances: to respond to your support questions, to notify you of material changes to our policies or website, to request your participation in user surveys, and to deliver products, services and marketing communications that you request. We will use Non-personally Identifiable Information to diagnose problems with our servers and software, to administer the Services, and to gather demographic information. Our thirdparty advertising networks and servers will also provide us reports that will tell us how many ads were presented and clicked upon on Zetavintage in a manner that does not identify personally an individual.

Cookies

Zetavintage may set and access Zetavintage cookies on your computer. Upon your first visit to the Services, a cookie is sent to your computer that uniquely identifies your browser. A “cookie” is a small file containing a string of characters that is sent to your computer and stored on your hard drive when you visit a website; many major Web services use them to provide useful features for their users. Each web site can send its own cookie to your browser. Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent; however if you reject cookies, you will not be able to sign in to the Services or take full advantage of our Services. Zetavintage uses cookies for the following general purposes: (a) to track your preferences, such as the address or local zip code you enter; (b) to access your information when you sign in so we can provide you with your personalized content ; (c) to display the most appropriate advertisements, based on your interests and activity on our web site; and (d) and to help us analyze and estimate our traffic and use of features on the Services. We may also use “pixel tags,” which are small graphic files that allow us to monitor the use of the Services. A pixel tag can collect information such as the IP address of the computer that downloaded the page on which the tag appears; the URL of the page on which the pixel tag appears; the time (and length of time) the page containing the pixel tag was viewed; the type of browser that retrieved the pixel tag; and the identification number of any cookie previously placed by that server on your computer. We may use pixel tags, either provided by us or by our third party advertisers and ad networks, to collect information about your visit, including the pages you view, the links you click and other actions taken in connection with our sites and Services and use them in combination with our cookies to provide offers and information of interest to you. We also may allow certain analytic services and providers of applications used on the Services (e.g. sharing buttons) to collect Non-Personally Identifiable information by placing cookies on the Services that will track certain performance of our Services, such as, web traffic, click-throughs, etc., in Zetavintage Advertising We may use other companies under agreements with us to serve advertisements when you visit and use the Services. These companies may collect and use Non-Personally Identifiable Information (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to the Services and other Web sites to provide advertisements about goods and services likely to be of greater interest to you. To learn more about this behavioral advertising practice and your options, including opting out, visit www.networkadvertising.org.
